NOTICE TO THE PUBLIC

Pursuant to the mandates of 12 G.C.A. § 12015.5 established under Public Law 26-164, the Guam Waterworks Authority (“GWA”) is required to establish and implement a water and sewer system development charge which shall be assessed to users who connect to GWA’s public water and sewer system for the first time or for existing users who are increasing the density of their development. The purpose of the assessment is to recover costs associated with constructing, expanding, upgrading and repairing the system to accommodate the new users and users who are placing an additional burden upon GWA’s system. Currently, no system development charge exists which means that GWA is not increasing an existing rate, rather the charges are completely new. On January 15, 2008 the Consolidated Commission on Utilities (“CCU”) held a duly noticed public hearing to seek input from the public on the proposed System Development Charge. After the hearing, on March 25, 2008, the CCU authorized GWA to petition the Guam Public Utilities Commission for its approval of the proposed system development charges. GWA intends to submit a petition to the Guam Public Utilities Commission for approval of the proposed charges set forth below in one month from the date this notice was mailed.
